User Licence Agreement

1. Parties of Agreement
The following terms are defined for use in this Agreement: 
"User" means the individual or business entity or other entity 
subscribing to RadixIndex Databases. "Service Provider" means 
Janos Bogardi (postal address: H-7634 Pecs, Uj fasor 28. 
Hungary. web address: http://www.radixindex.com), who runs 
RadixIndex Databases.

2. Description of Service
Service Provider operates world-wide web based databases and 
other resources relevant to Hungarian genealogy research, known 
as RadixIndex. With his/her subscription User is 
given the right to browse and search in the members-only area 
of databases and resources, and to download records or other 
resources that User is interested in. To prevent abuse of 
resources, the number of downloadable records is set to a limit 
of 100 records per subscription. If User wants to download more 
records, he/she has to open a new account and pay the price of 
the new account.

3. Scope of Service
User is entitled to use RadixIndex Databases and resources. 
Although negiotiable under a separate heading, family history or 
other related research that can not be accomplished using 
RadixIndex is not part of the Service.

4. Upgrades
User can claim to have access to resources available at the 
time of his/her subscription only. Service Provider has a 
commitment to strive after adding new data and improving usage 
of already existing resources. Service Provider in its sole 
discretion might, and usually does give access to the new 
additions and improvements to users subscribed before the 
upgrade.

5. Handing on information to third parties
User can hand on information, records whatsoever gained from 
RadixIndex to third parties, either for free, or for fees or 
for other benefits. User does not need to send notice to Service 
Provider of this passing on. User must, however, give reference 
to RadixIndex URL: http://www.radixindex.com when passing on 
information, records whatsoever gained from RadixIndex.

6. Sharing accounts
User might share his/her account with others, but RadixIndex can 
not under any circumstances be liable for misuse or for 
exploitation due to shared usernames. Account usage from 
different computers is not monitored by RadixIndex.

7. Liability
7a. Service Provide makes data accessible to subscribers bona 
fide. Service Provider makes no representations concerning the 
suitability, reliability or accuracy of the content provided on 
the Service for any purpose.

7b. Service Provider and its third party partners assume no 
liability for disruptions of their services, including, but not 
limited to, vandalism, theft, power outages, Internet disruptions, 
extreme or severe weather conditions or any other causes in the 
nature of "ACTS OF GOD" or force majeure. Service Provider shall 
not be responsible for consequential damages or punitive or 
exemplary damages under any circumstances. 

7c. The information and services included on this web service may 
include inaccuracies or typographical errors. Changes are 
periodically added to the information herein. 

8. Termination
User can cancel his/her account anytime without prior notice to 
Service Provider. Partial refund based on accounts not using up 
all the granted number of records is not possible. When User 
reaches the number of record limit, he/she can download no more 
records, still, he/she can continue using other resources found 
on RadixIndex.

9. Modifications to this Agreement
Service Provider may alter this agreement at his discretion. 
User's continued use after any change indicates his/her acceptance 
of that change. If User does not want to be bound by a change, 
he/she should discontinue use of the Service.
